NBA Sues IGP Over Tinted Glass Permit Policy

The Nigerian Bar Association (NBA) has filed a public interest lawsuit against the Inspector-General of Police (IGP), Kayode Egbetokun, challenging the legality of the newly introduced tinted glass permit policy.

According to the association, the suit, marked FHC/ABJ/CS/182/2025, was filed on September 2 at the Federal High Court in Abuja and is yet to be assigned to a judge.

The policy, introduced in April 2025 and scheduled for enforcement beginning October 2, mandates motorists to obtain annual permits for tinted vehicle glass through a digital portal (possap.gov.ng).

The NBA, during its National Executive Council meeting in Enugu on August 23, resolved to contest the directive, citing concerns over transparency, legality, and human rights violations.

Paul Ananaba, chairman of the NBA’s Section on Public Interest and Development Law (SPIDEL), says the portal is reportedly managed by a private vendor, Parkway Projects, and that payments are being routed to a private account rather than the Federation Account or Treasury Single Account. The association also alleges that citizens have already faced harassment and extortion at police checkpoints under the guise of enforcing the policy.

The NBA argues that the directive infringes on rights to dignity, privacy, freedom of movement, and property, and questions its legal foundation, which appears to rely on the Motor Tinted Glass (Prohibition) Act—a 1991 military decree. The association contends that the law may not meet the constitutional standard of being “reasonably justifiable in a democratic society.”

The NBA has called on the police to suspend enforcement of the policy pending the outcome of the court case.
